Option to Purchase

The first tender and the project of the APVCS of the Immigration Department commenced in 2003 under a tender Ref: PT/0202/2003. Under the Conditions of Contract, there is an 'Option to Purchase' which allows the Government to purchase from the existing contractor of APVCS such additional items of Contractor Supplied Hardware and Contractor Supplied Software at the prices specified in Schedule 18 or the prevailing market price (whichever is lower) as and when required by the Government within 48 months from the Contract Date. The existing contractor shall, within 3 months from the Government's written request(s), deliver and provide Ready for Use those items to such locations as may be specified in the written request(s). Clearly, those locations shall include the New Control Point as specification in the tender Ref: PT/0273/2006.

Please kindly clarify how this clause and terms and conditions of the contract then made will affect the tender evaluation of this Tender and the purchase decision of the Government. Please clarify whether the tender bid price of this tender Ref: PT/0273/2006 shall form the basis of the prevailing market price for the Government to negotiate with the existing contractor for the purchase of the items for the New Control Points. Should the tender price of the successful tenderer of this tender be higher than the prices made under the 'Option to Purchase' of previous tender, how the Government purchase decision will be affected.

Please refer to the Clause 18.1 and 18.2 of Part II of Tender. Government will conduct tender evaluation in according with Clause 16 of Part II of Tender.
