We consider the "Time to Delivery" of the project as a very material specification and requirement of this tender. According to Articles XI Section 4 of WTO GPA, tenderer and contractor should be provided with adequate "Time to Delivery". From the tender specification, a period 5 months is specified as the time available and allowed counting from the date of contract award and production rollout start before end of 2006 to the end of production rollout in April 2007. Please clarify and confirm that whether a period of 5 months shall still be maintained and allowed as the "Time to Delivery" should the contract award date and production rollout start are postponed due to whatever reasons.
We would like the Department to take note that unclear clarification to the "Time to Delivery" may prohibit the tenderer to participate in this open tender bid, it may also constitute perceived advantages to the existing AVCS contractor, and therefore, an unfair and improper tendering process. It may also violate or breach the WTO GPA Clauses.
Answer :
The Government will adopt an open and reasonable manner towards the impacts arising from any delay. Upon awarding of the Contract, the Government will join in the Contractor to review the implementation plan as specified in section 3.2 of Part VII. |
