Policy Statement

1.	The Immigration Department attaches great importance to the protection of privacy in relation to personal data and is committed to complying with the provisions of the Personal Data (Privacy) Ordinance (PD(P)O).
2.	You may view and download our department’s “Statement of Privacy Policy and Practices” at “Useful Information and Statistics” of our Homepage (https://www.immd.gov.hk/eng/index.html).
3.	Collected personal data is used for the purpose for which the data was to be used at the time of the collection or for a directly related purpose, unless the individual concerned has given prescribed consent for the data to be used for a new purpose or such use is permitted by law.

Collection of personal data

During enrolment of e-Channel Service using this Application, the types of personal data collected include travel document number, name, sex, date of birth, nationality, date of expiry of travel document and photo of the applicant for processing the enrolment and providing subsequent e-Channel service. In the course of using this Application, personal data (e.g. system identifiers, usage data, etc.) may be generated and collected.

During enrolment process, a live photo will be taken via this Application for verification of your identity and the rightful holder of the travel document. The live photo will be recorded as part of your enrolment record for using e-Channel service during immigration clearance in Hong Kong SAR.

Purpose of Collection

The personal data and the facial image provided will be used by the Immigration Department for one or more of the following purposes: To process your enrolment; To verify your eligibility and/or continued eligibility for use of the e-Channel service; To carry out immigration clearance and examination of persons entering into or departing from Hong Kong SAR; To administer/enforce relevant provisions of the Immigration Ordinance (Chapter 115) and Immigration Service Ordinance (Chapter 331), and to assist in the enforcement of any other Ordinances and Regulations by other government bureaux and departments through carrying out immigration control duties; Statistics and research purposes on the condition that the resulting statistics or results of the research will not be made available in a form which will identify the data subjects or any of them; and Any other legitimate purposes as may be required, authorized or permitted by law. The provision of personal data in the process of your enrolment is voluntary. If you do not provide sufficient information, we may not be able to process your enrolment.

Disclosure of Data

Save and except for the purposes stated in the Purpose of Collection applicable to that user, or for purposes exempted under the Personal Data (Privacy) Ordinance PD(P)O, the personal data including facial data will not be transmitted to any third parties for whatever purposes without his/her prior consent. Exemptions include the passing of personal data to law enforcement agencies who are authorised to receive information relating to prevention or detection of crime.

Data Retention

The Immigration Department maintains and executes retention policies of records containing personal data in relation to enrolment for using e-Channel service to ensure personal data will not be kept longer than is necessary for the fulfilment of the purpose for which the data is or is to be used and in accordance with the relevant statutory provisions. The retention periods apply to various kinds of data collected and held in the enrolment system are varied. If you withdraw your consent given, the corresponding data collected will be erased.

Cancellation of e-Channel Service

If you apply to cancel the e-Channel service, you agree to delete your enrolled personal data including facial image from the system; You understand that you must meet the eligibility criteria and re-enrol before you can use the e‑Channel service again; and you can use this Application or visit the Enrolment Office to cancel the e-Channel service.

Access to Personal Data

10.	You have a right to request access to and correction of your personal data as provided for in sections 18 and 22 and Principle 6 of Schedule 1 of the Personal Data (Privacy) Ordinance (Chapter 486). Your right to access includes the right to obtain a copy of your personal data provided in the consent form subject to payment of a fee.
